RICHMOND, VIRGINIA - Attorney General Bob McDonnell has issued an advisory opinion that executive orders ensuring equal state employment rights for gays is unconstitutional.The opinion he released today is NOT binding on state law but could provoke a legal battle between the Republican attorney general and Governor Tim Kaine, who is a Democrat.
Former Governor Mark Warner imposed the nondiscrimination policy on January 12th, just two days before he left office.
Kaine signed a similar order instituting the same policies moments after he was inaugurated in Williamsburg.
Delegate Bob Marshall, a Republican from Prince William County, sought the advisory opinion.
